Chapter 13 - THE LAST OFFER

Three weeks passed before Richard asked for mediation again.
By then, almost nothing in his life looked the way it had when Khloe first found Vanessa's message.
He was still wealthy on paper.
He still owned shares.
He still lived in the Lower Merion estate under temporary terms.
But access had changed.
The board controlled company finances.
The court controlled disputed assets.
Auditors controlled records.
Lawyers controlled every conversation that mattered.
For a man who had spent his life believing money meant freedom, Richard had discovered the opposite.
Money under investigation became a cage.
Khloe arrived at mediation eight months pregnant.
Her daughter had grown strong enough that every movement showed beneath the fabric of her maternity dress.
Dr. Morris had told her to reduce stress.
Khloe had laughed at the phrase.
Still, she had followed every medical instruction she could.
She attended fewer meetings.
She slept more.
She moved into a larger apartment with room for a crib.
And for the first time, she chose a name.
Rose.
After her mother.
Only Harrison knew.
The mediator was a retired judge named Malcolm Avery.
He had no patience for moral speeches.
He wanted numbers.
Assets.
Liabilities.
Parenting proposals.
Confidentiality terms.
And a path to settlement.
Richard sat in a separate room.
Vanessa was not part of the mediation.
She had given birth to a healthy baby boy ten days earlier.
Richard had visited the hospital.
A photographer had captured him leaving through the parking garage.
The picture showed no smile.
Khloe had looked at it once and closed the article.
The baby was innocent.
She refused to turn a child's birth into evidence of her own humiliation.
At eleven, Judge Avery entered Khloe's conference room.
"There is an offer."
Harrison looked up from his notes.
"We are listening."
The retired judge named a division of assets far larger than Richard's first proposal.
The Lower Merion estate would be sold.
Khloe would receive restoration of traced trust funds plus interest.
Richard would surrender claims to several investment accounts.
He would provide child support under a high-income formula.
And he would establish a trust for their daughter.
Khloe listened carefully.
Then Judge Avery reached the condition that mattered.
"Mutual confidentiality."
Harrison's expression changed.
"Define it."
"No public discussion of affairs, financial transfers, medical disclosures, business investigations, or litigation conduct."
Khloe looked at Harrison.
"He wants silence."
Avery nodded.
"He wants finality."
"Those are not the same thing."
The retired judge studied her.
"What do you want, Mrs. Harrington?"
Khloe looked down at her hands.
Six months earlier, she would have said she wanted her marriage back.
Three months earlier, she would have said she wanted Richard punished.
Now the answer was different.
"I want my money returned."
"I want the records corrected."
"I want my daughter protected."
"And I will not sign anything that stops me from answering truthfully if a regulator, court, investigator, or my daughter someday asks what happened."
Avery nodded.
Harrison said nothing.
The mediator returned to Richard's room.
An hour later, he came back.
"Mr. Harrington will narrow confidentiality to media statements and commercially sensitive information."
Khloe shook her head.
"No restriction on discussing my own medical history."
"Agreed."
"No restriction on cooperating with investigators."
"Agreed."
"No restriction on discussing facts already made public in court records."
Avery paused.
"That is where he is resisting."
Khloe leaned back.
"Then he can keep resisting."
Harrison looked at her with quiet approval.
The mediator left again.
At two, Richard requested a face-to-face session.
Harrison advised against it.
Khloe surprised him.
"I want one."
"Why?"
"Because I am done hearing his voice through other people."
The meeting occurred in a larger conference room.
Two lawyers sat on each side.
Judge Avery remained at the head of the table.
Richard entered last.
Khloe had not seen him up close in weeks.
He looked thinner.
There were shadows beneath his eyes.
His confidence had not disappeared.
It had hardened into resentment.
He sat across from her.
For several seconds, they simply looked at each other.
Richard spoke first.
"You look well."
Khloe almost smiled at the absurdity.
"So does our daughter."
His eyes moved toward her stomach.
Something complicated crossed his face.
"Can I ask when you're due?"
"You have the medical schedule through counsel."
He looked away.
The mediator began discussing terms.
Richard barely listened.
Finally, he interrupted.
"Why are you doing this?"
Harrison started to respond.
Khloe lifted one hand.
"Doing what?"
"Dragging everything into the light."
"You could have taken the first settlement and walked away richer than most people will ever be."
Khloe stared at him.
"You took money my mother left me."
"It was invested."
"You bought a home for Vanessa with it."
Richard's mouth tightened.
"That was not the original intention."
"You leaked my grief counseling."
"I did not leak anything."
Harrison placed a hand on the table.
"Careful."
Richard ignored him.
"A consultant discussed background."
Khloe leaned forward.
"My miscarriages were not background."
The room went silent.
"They were my children."
Richard's face changed.
For one moment, shame appeared.
Then defensiveness buried it.
"You think I didn't lose them too?"
Khloe felt a sharp ache.
"Maybe you did."
"But I didn't turn that loss into a press strategy."
Richard looked down.
Judge Avery intervened.
"We are here to resolve legal claims."
Khloe nodded.
The numbers resumed.
At four-thirty, they were close.
Then Martin Keane received a phone call.
He left the room.
When he returned, his face had changed.
He whispered to Richard.
Richard went pale.
Harrison noticed instantly.
"Problem?"
Martin closed his folder.
"We need to adjourn."
Avery frowned.
"We are within an hour of a term sheet."
"We need to adjourn."
Richard stood abruptly.
Khloe watched him.
"What happened?"
He looked at her with something close to hatred.
"Ask your brother."
Harrison's expression remained blank.
"I have no idea what you're talking about."
Richard left.
Within twenty minutes, they learned the reason.
Federal investigators had served subpoenas on Harrington Commercial Group, Keystone Civic Futures, and two related consulting firms.
The financial inquiry was no longer theoretical.
It was official.
Khloe looked at Harrison.
"Did you know this was happening today?"
"No."
"Will he believe you?"
"No."
She looked toward the closed door Richard had disappeared behind.
"Then settlement is over."
Harrison nodded.
"For now."
That night, Richard went to Vanessa's apartment.
She opened the door only because the nanny was awake in the next room.
Their son slept in a bassinet near the window.
Richard looked at the baby.
His expression softened.
"Can I hold him?"
Vanessa crossed her arms.
"Why are federal agents subpoenaing your company?"
Richard's face tightened.
"How do you know?"
"Paige called."
"Why did your lawyer call you before I did?"
"Because my lawyer understands I am involved whether I like it or not."
Richard lowered his voice.
"This has nothing to do with you."
Vanessa laughed bitterly.
"The penthouse is in an entity connected to your transfers."
"My medical bills were paid through your companies."
"My name is in emails."
"Everything has something to do with me now."
Richard looked toward the bassinet.
"I need you to trust me."
Vanessa stared at him.
"That sentence used to work."
He looked back at her.
"What does that mean?"
"It means I gave Paige the recording."
Richard went completely still.
"What recording?"
Vanessa held his eyes.
"The night you told me not to become moral."
His face drained.
"You recorded me?"
"Yes."
"Delete it."
"No."
The word echoed in the apartment.
Richard stepped closer.
"Vanessa."
She stepped backward toward the bassinet.
"Do not come closer."
He stopped.
The fear on her face was small but real.
It changed him.
For one second, Richard saw himself from outside.
A furious man advancing on the mother of his newborn child because she had preserved evidence.
He lowered his hands.
"I'm not going to hurt you."
Vanessa's eyes filled.
"Khloe probably believed that too."
Richard flinched.
She opened the door.
"Leave."
This time, he did.
In the hallway, Richard stood alone for a long time.
Then his phone buzzed.
A message from an unknown number appeared.
You should be more worried about what your wife has than what Vanessa recorded.
Richard stared at the screen.
A second message arrived.
