Chapter 8 - The Custody Petition

Rachel left Evelyn's house with one certainty and a dozen new questions.

Adrian Vale had apparently used the same private specimen code in Grant's conception and Maddie's conception more than three decades apart.

Evelyn had known the code was connected to Grant by the time he was twelve.

She had also discovered that the code appeared in unrelated donor cycles.

Then she had surrendered a copied donor log to the very man she suspected.

Rachel wanted to scream at her.

Instead she called Julia.

"We need to document everything Evelyn just told me."

Julia's answer was immediate.

"Write it down before you forget exact language."

"I'm driving."

"Pull over."

Rachel did.

For fifteen minutes, she dictated every admission she could remember into an email.

She included the exact phrases.

She included where Evelyn looked when she answered.

She included the claim that Bennett family money helped finance Northlake.

Julia listened without interrupting.

When Rachel finished, the attorney was silent for a moment.

"This is larger than a donor mix-up."

"I know."

"If the investment claim is true, there may be financial records outside Northlake's control."

"Can you get them?"

"Possibly."

Rachel looked through the windshield at cars passing on the highway.

"Evelyn said Adrian took the copied donor log."

"That may be true."

"You don't believe her?"

"I believe people under pressure sometimes tell a truth that makes them look less guilty than the whole truth would."

Rachel thought about that.

"You think she kept a copy."

"I think we should not assume she handed over the only one."

Rachel returned to Nora's house just after noon.

Maddie was at kindergarten.

Nora had left soup on the stove and a note telling Rachel to eat something.

Rachel barely got through three spoonfuls before the doorbell rang.

A process server stood on the porch.

He asked whether she was Rachel Bennett.

Her stomach dropped.

She accepted the envelope.

Grant had filed an emergency custody motion.

Rachel read the first page twice before understanding the language.

He alleged she had removed Maddie from the marital home without agreement.

He alleged she was exposing Maddie to "adult reproductive and genetic conflict."

He asked for temporary shared physical custody and an order preventing either parent from submitting Maddie's DNA to additional databases without joint consent.

Rachel could not believe it.

She called Grant before calling Julia.

He answered on the first ring.

"You filed against me?"

"My attorney filed a temporary motion."

"You told me you didn't want a war."

"I don't."

"Then why am I holding court papers?"

Grant's voice was tight.

"Because you are making decisions about Maddie's genetic information without me."

"We agreed to the accredited test."

"Not the commercial database."

Rachel stood from the table.

"I ordered that before we agreed to anything."

"Cancel it."

"No."

"Rachel, her DNA could be online forever."

"That concern would sound more sincere if you hadn't hidden your own test for three years."

"Mine is different."

"Because it belongs to you?"

"Yes."

"Hers belongs to her."

"Then why are you making the decision?"

Rachel stopped.

He had a point, and she hated that he had chosen a court filing to make it.

"Because she is five and needs adults to protect her medical interests."

"Exactly."

Grant's voice softened.

"Both adults."

Rachel stared at the motion.

"You could have called me."

"You don't answer half my calls."

"Because most of them are about your mother's reputation."

"This one isn't."

"Then why did your petition include a paragraph accusing me of trying to alienate Maddie from the Bennett family?"

Grant went quiet.

Rachel's anger returned.

"Your attorney wrote what you told him."

"My mother gave him background."

Rachel almost dropped the phone.

"Your mother spoke to your custody attorney about me?"

"She knows the family situation."

"She is the family situation."

"Rachel -"

"She just admitted Adrian Vale used AV-P13 in your conception."

Grant stopped breathing on the other end.

"What?"

Rachel closed her eyes.

Part of her had wanted to tell him face to face.

Another part believed he had forfeited the privilege when a process server arrived at Nora's door.

"She said she found your conception record when you were twelve."

Grant did not speak.

"She said Thomas's sample was supposed to be used."

Still nothing.

"She said Vale showed her the record after she copied one of his donor logs."

Grant finally whispered.

"She knew."

"For more than twenty-five years."

Rachel heard something fall on his end.

"Grant?"

"I'm here."

His voice was distant.

"She watched me go to Vale three years ago."

Rachel said nothing.

"She watched me ask whether Thomas was my father."

His breathing became uneven.

"She watched me think I was losing my mind."

Rachel's anger softened despite herself.

"Yes."

"And she knew."

"Yes."

Grant made a sound that was almost a laugh and almost a sob.

Then he ended the call.

Rachel called Julia.

Julia was furious about the filing but not surprised.

"Emergency motions are often strategic."

"Can he take Maddie from me?"

"Not based on what I have read."

"He says I exposed her to genetic conflict."

"Did you tell Maddie Vale might be her biological father?"

"Absolutely not."

"Did you tell her Grant might be her half brother?"

"No."

"Then the claim is weak."

Rachel looked at the envelope.

"What about the DNA database?"

"That is a real privacy issue."

"I know."

"We can propose that any testing happen through accredited confidential channels unless both parents agree otherwise."

Rachel frowned.

"But the sibling cluster came from commercial matches."

"We already have enough people willing to provide certified comparison samples."

Rachel exhaled.

"Fine."

"We can be reasonable without giving him control over the investigation."

The hearing was scheduled for the following morning.

Grant arrived with an attorney named Stephen Cole.

Evelyn sat directly behind them.

Rachel felt her jaw tighten.

Nora whispered.

"She really came."

Julia glanced back.

"Let her."

Maddie was at school and knew nothing about the hearing.

Rachel intended to keep it that way.

The judge, Maria Alvarez, reviewed the filings with visible impatience.

She looked first at Grant.

"Mr. Bennett, did you tell members of your family that Maddie was not your child?"

Stephen Cole stood.

"Your Honor, the statement was made in anger and has been taken out of context."

Judge Alvarez looked over her glasses.

"Is there a context in which a legal parent publicly disclaiming a five-year-old becomes helpful?"

Cole sat down.

Grant answered quietly.

"No."

"Did Maddie hear you?"

"Yes."

"Did you apologize?"

"Yes."

Judge Alvarez turned to Rachel.

"Mrs. Bennett, did you remove Maddie from the marital home that evening?"

"Yes."

"Did you tell Mr. Bennett he could not see her?"

"No."

Julia provided the text messages arranging the apology and pancake breakfast.

The judge read them.

Then she looked at the DNA issue.

"I am less interested in the adults' curiosity than in this child's privacy and medical welfare."

Rachel nodded.

"So am I."

Judge Alvarez issued a temporary order requiring joint notice for further DNA testing but allowed medically relevant certified testing to continue if recommended by counsel and specialists.

She did not order Maddie returned to the marital home.

She ordered a temporary parenting schedule.

She also ordered both parents not to discuss biological parentage disputes with Maddie until they had guidance from a child therapist.

Rachel agreed immediately.

Grant did too.

Then Stephen Cole stood again.

"Your Honor, there is another matter."

Julia looked at Rachel.

Neither had expected this.

Cole held up a folder.

"Mr. Bennett has reason to believe Mrs. Bennett is coordinating with third parties to publicly accuse a respected physician of reproductive misconduct."

Judge Alvarez's expression hardened.

"How is that a custody issue?"

"Public exposure could identify the child."

Julia stood.

"My client has made no public statement identifying Maddie."

"Not yet."

Cole looked toward Rachel.

"But she has contacted a private group of donor-conceived families and shared records."

Rachel's heart jumped.

How did he know that?

Julia answered.

"She shared her own records with adults investigating an apparent clinic irregularity."

Cole opened the folder.

"We have screenshots."

Rachel stared.

The private Northlake group did not allow public sharing.

Only members could see posts.

Someone inside the group had sent screenshots to Grant's lawyer.

Judge Alvarez refused to turn the custody hearing into a defamation case.

She warned both sides about privacy and ended the matter.

Rachel barely heard the final instructions.

She was staring at the screenshots in Cole's hand.

Outside the courtroom, she confronted Grant.

"Where did you get those?"

Grant frowned.

"My attorney received them."

"From whom?"

"I don't know."

"Your mother?"

"No."

"Vale?"

Grant looked at Stephen Cole.

The attorney's expression gave Rachel the answer before he spoke.

"The materials were provided by counsel representing a concerned third party."

Julia stepped closer.

"Which third party?"

Cole refused to answer.

Rachel's phone buzzed.

It was Lauren Pike.

Rachel opened the message.

Someone in the Northlake group had just deleted their account after downloading months of posts.

Lauren had traced the user's invitation history.

The account had been admitted six months earlier under the name Margaret Shaw.

Rachel remembered Dr. Marsh mentioning legacy staff.

She searched the name on her phone.

Margaret Shaw had been Northlake's senior embryology nurse for twenty-eight years.

She had retired the same month Adrian Vale did.

Rachel showed the screen to Julia.

Julia's face changed.

"Do you know her?"

"No."

Rachel looked toward Grant, then Evelyn.

Evelyn had gone completely pale.

Rachel noticed.

"You do."

Evelyn shook her head too quickly.

"No."

Rachel stepped closer.

"Who is Margaret Shaw?"

Evelyn looked toward the courthouse elevators.

For one second, Rachel thought she might run.

"The woman who prepared the sample when Grant was conceived."
