Chapter 5 - The Man Who Never Testified

The two detectives waiting in the archive lobby introduced themselves as investigators from the county public integrity unit, which would have sounded reassuring if Claire had not spent four years learning how easily reassuring titles could hide dangerous intentions.

Detective Laura Kim was in her early forties, calm-eyed and precise, while her partner, Detective Mark Evans, looked impatient before Claire had even reached the front desk.

"Mrs. Walker, we need to ask you a few questions."

Nora stepped between them.

"She is represented."

Evans looked at Nora.

"We are aware."

"Then direct your questions through me."

Kim held up a hand before Evans could answer.

"This can be informal."

Nora gave her a cold smile.

"Nothing involving my client and the words 'tampering with evidence' is informal."

Claire stood very still.

"Did Paul Rourke call you?"

Kim's expression shifted almost imperceptibly.

"Why would you ask that?"

"Because he entered this building this morning using access he should not have had, and the locker connected to my husband's case is now empty."

Evans looked at Dennis.

Dennis immediately looked away.

Nora produced the signed preservation order.

"We have already notified Judge Hart."

Kim read the first page.

Her face tightened.

"Who told you Rourke accessed the locker?"

Dennis swallowed.

"The system log."

Evans turned toward him.

"You should not have disclosed internal security data."

Nora's voice hardened.

"You should be more concerned that a retired detective entered a restricted archive during a conveniently timed camera outage."

Kim looked at Evans.

Something unspoken passed between them.

Then Kim handed the order back to Nora.

"Mrs. Walker is not under arrest."

Claire did not relax.

"Then why are you here?"

Kim lowered her voice.

"Because someone reported that you possessed stolen evidence from a closed criminal case."

"Who?"

"Anonymous source."

Claire almost laughed.

"Of course."

Nora stepped closer to Kim.

"My client received material she did not request, and we preserved it through forensic counsel."

Kim nodded slowly.

"That was the correct decision."

Evans looked annoyed.

"Laura."

Kim ignored him.

"I would like a copy of the forensic image when your counsel is ready to provide it."

Nora's eyes narrowed.

"Why?"

Kim glanced toward the cameras.

"Because Rourke's name has surfaced in another complaint."

Evans spoke sharply.

"That is not relevant."

Kim turned toward him.

"It became relevant when his retired credentials opened Locker 214."

Claire watched them carefully.

For the first time that day, she saw a fracture inside law enforcement instead of a solid wall.

Nora noticed it too.

"What complaint?"

Kim looked at Claire.

"A witness from an old robbery case says Rourke pressured him to change a statement."

Claire's pulse jumped.

"Which robbery?"

Kim hesitated.

"Crestview Jewelry Exchange."

Claire gripped the edge of the counter.

"Who is the witness?"

"His name is Samuel Ortiz."

Nora's face changed.

"That name is not in the trial transcript."

"Because he never testified."

The words hung between them.

Claire stepped forward.

"What did he see?"

Kim shook her head.

"I cannot discuss details."

"My husband is in prison because of that case."

"I know."

"Then tell me what he saw."

Kim looked at Evans, then back at Claire.

"He says he saw Ethan Walker's truck more than an hour before the robbery."

Claire's heart pounded.

"Where?"

"At a repair shop six miles away."

"That was Ethan's alibi."

"Yes."

"The jury was told there was no independent witness."

Kim's jaw tightened.

"Apparently there was."

Nora pulled out her notebook.

"Where is Samuel Ortiz now?"

Kim did not answer immediately.

Evans stepped forward.

"This conversation is over."

Nora ignored him.

"Detective Kim?"

Kim looked toward the front windows.

"Samuel contacted internal affairs three days ago."

Claire felt hope rise and then stop when she saw Kim's expression.

"What happened?"

"He disappeared yesterday morning."

Claire stared at her.

"Disappeared?"

"His apartment is empty, his phone is off, and he did not show up for work."

Nora closed her notebook.

"Was there evidence of foul play?"

"No."

Evans cut in again.

"Laura, enough."

Kim looked at Claire one last time.

"If Samuel Ortiz contacts you, call me before you call anyone else."

She slid a card across the counter.

Claire took it.

"Including Rourke?"

Kim's eyes went cold.

"Especially Rourke."

The detectives left.

Nora waited until the door closed.

"I do not trust Evans."

"I don't trust anyone with a badge right now."

"Kim may be different."

"May be is not enough."

Claire looked at the clock.

It was 3:16 P.M.

"Ryan wants to meet at seven."

"You are not meeting him alone."

"I know."

"You are not bringing Lily."

"I know."

"And we are not telling the police where."

Claire looked at Nora.

"I thought you might trust Kim."

"I said may be."

At 6:38 P.M., Claire sat in the passenger seat of Nora's car two blocks from the abandoned Riverfront bus depot.

Dean had Lily at Nora's apartment with Nora's sister, and Officer Grant had agreed to tell Ethan only that Claire and Lily were safe.

Rain had started again, thin and steady against the windshield.

Nora checked the time.

"If Ryan is not there by seven-ten, we leave."

"He will come."

"You do not know that."

"He sounded terrified."

"Terrified people are unpredictable."

At 6:54, a silver sedan pulled into the depot lot.

Ryan got out.

Claire barely recognized him.

He had lost weight, his beard was uneven, and he kept looking over his shoulder.

Nora handed Claire a small recording device.

"Keep it in your coat."

Claire tucked it into her pocket.

"You are coming with me."

"No."

Claire turned sharply.

"Nora."

"He asked for you, and I will be thirty feet away."

"What if he runs?"

"Then I get his plate and we stop pretending he is cooperating."

Claire got out and crossed the wet pavement.

Ryan stood beneath the broken depot awning.

For several seconds, brother-in-law and sister-in-law simply looked at each other.

Then Claire slapped him.

The sound cracked through the empty station.

Ryan did not raise a hand.

"I deserved that."

"You deserve four years."

He looked down.

"I know."

"Where is the drive?"

Ryan reached slowly inside his jacket.

Claire stiffened.

He removed a small padded envelope.

"Here."

She did not take it.

"Tell me first."

Ryan's eyes filled with shame.

"I borrowed Ethan's truck that night."

"Why?"

"Wade Mercer said he needed help moving stolen electronics."

Claire stared at him.

"You knew they were stolen?"

"I knew they were probably stolen."

"And you thought that was fine?"

"I was twenty-six, broke, and stupid."

"Ethan was thirty-one, married, and trusting you."

Ryan flinched.

"I know."

"What happened?"

"Wade changed the plan after I got there."

"To robbery?"

Ryan nodded.

"I told him I was leaving."

"But you stayed."

"Because Rourke arrived."

Claire went still.

"Why was a detective there before a robbery?"

Ryan looked toward the dark street.

"Because Wade was his informant."

Claire felt the pieces shift.

"Rourke knew."

"He knew something was going to happen."

"And he let it?"

Ryan nodded miserably.

"Wade was supposed to deliver information on a bigger crew."

"So Rourke let him rob a store?"

"It was supposed to be controlled."

Claire almost laughed from disbelief.

"A security guard was hospitalized."

"Wade panicked."

"And then what?"

Ryan looked directly at her.

"Then Rourke decided he needed someone else to take the case."

Claire's voice became quiet.

"Ethan."

Ryan nodded.

"The truck was in his name."

"What about the glove?"

Ryan closed his eyes.

"It came from Ethan's garage."

Claire stepped backward as if he had struck her.

"You gave it to them."

"No."

"Then how did they get it?"

"I told Rourke where Ethan kept his work gloves."

Claire's face twisted.

"Why?"

"Because Rourke told me if I didn't cooperate, I would be charged with the robbery and Ethan would lose me too."

"So you let Ethan lose eighteen years instead."

"I thought Rourke was going to fix it before trial."

"You sat through the trial."

"By then he had me trapped."

"You could have told the truth."

Ryan's voice broke.

"He showed me photographs of Lily at daycare."

Claire froze.

"What?"

"He told me accidents happen to families who destroy police careers."

Claire suddenly understood why Ryan had stopped visiting after eighteen months.

"Why now?"

"Because Samuel Ortiz called me last week."

Claire stepped closer.

"Where is he?"

Ryan looked toward the road again.

"Safe for now."

"You know where he is?"

"Yes."

"Take us to him."

"Not yet."

Claire's anger returned instantly.

"You do not get to say not yet."

Ryan held out the padded envelope.

"The original drive is in here."

Claire took it.

"Why did Rourke think it was in Locker 214?"

"Because I switched it years ago."

"With what?"

"A blank drive."

Claire stared at him.

"Why?"

"Because I was scared enough to stay silent but not brave enough to destroy the only thing that could free Ethan."

Claire looked at the envelope in her hand.

For the first time in four years, the physical source of the missing footage was inches from her fingers.

Nora stepped out of the shadows and approached.

Ryan looked startled.

"You brought her."

"Of course I brought her."

Nora held out an evidence bag.

"Put the envelope in here."

Claire did.

Ryan watched the bag seal.

"Now tell us where Samuel is."

A car engine roared from the far end of the street.

Ryan's face drained of color.

"Get down."

Headlights swung sharply into the depot lot.

Nora grabbed Claire's arm and pulled her behind a concrete pillar.

The vehicle stopped twenty yards away.

Its driver's door opened.

A man stepped out, but the headlights behind him turned his face into a silhouette.

Ryan backed away.

"No."

The man called across the rain.

"Ryan."

Claire knew that voice.

She had heard it on the flash drive.

Detective Paul Rourke stepped into the light.

"You have something that belongs to me."
