Chapter 14 - THE EMPTY COMPARTMENT

David's fingerprint inside Emma's music box was not enough by itself to prove he had taken the flash drive.

It was enough to destroy his claim that he knew nothing about it.

Detective Alvarez asked Andrew Cole to bring David in voluntarily.

Andrew called back twenty minutes later.

"He will surrender for questioning, but I need to know whether you plan to arrest him."

"I don't promise outcomes."

"Nina."

"Andrew."

They had worked opposite each other before.

They both knew the dance.

"He is finally willing to tell you everything," Andrew said.

"He has already had several opportunities."

"I know."

"Bring him."

David arrived just after 4:00 p.m.

He looked worse than he had at the hospital.

No tie.

Unshaven.

Eyes red from lack of sleep.

For once, he did not begin by demanding anything.

"I took the drive," he said.

Alvarez turned on the recorder.

"Start at the beginning."

David looked at Andrew.

Then he began.

Rachel had discovered accounting irregularities while working at Mercer Development two years earlier.

At first she told David privately because they were already dating.

He promised to investigate.

Instead, he asked his mother.

Evelyn told him the transfers were legitimate internal financing structures.

David believed her because that was easier.

Months later, Rachel found more records.

This time she copied them.

Their relationship deteriorated.

"Did you know the transfers were fraudulent?

Alvarez asked.

David rubbed his face.

"I knew some approvals were wrong."

"Yours?"

"Yes."

"Did you profit?"

"Not directly."

"That answer will interest federal investigators."

David closed his eyes.

"I know."

"Why did you take Rachel's phone?"

"Because she told me she had sent evidence to Claire."

Claire had not received it.

Rachel had only said that to scare him.

"Why did you take the document bag?"

"I thought the drive might be inside."

"And the custody papers?"

"I saw them.

I got angry."

"You removed them."

"Yes."

"Then you left Rachel without a phone."

"Yes."

"While she was bleeding."

David looked at the table.

"Yes."

"Then you came back."

"Yes."

"Describe that."

David's voice became quieter.

"Paul picked me up a few blocks from my office.

I didn't want my car seen at Rachel's house again because I knew she might call police."

Alvarez stared at him.

Even now the calculation was astonishing.

"So you were concerned about being seen, but not concerned enough about Rachel to bring medical help."

"I thought Nora was coming."

"Did you see Rachel when you returned?"

"Yes."

"Condition?"

David's face broke slightly.

"Worse."

"Conscious?"

"Barely."

"Did she speak?"

"She told me to leave."

"Did Emma speak?"

His eyes filled.

"She asked me to pick her mom up."

Alvarez let that sit.

David covered his face with both hands.

"I thought if I called an ambulance, Rachel would tell police everything."

"About the finances?"

"About everything.

The control.

The investigator.

The phone."

"So you left."

"Yes."

"Again."

"Yes."

Alvarez's voice was almost flat now.

"Then you searched Emma's music box."

David nodded.

"My mother had taken it.

She thought Rachel might hide something in Emma's belongings."

"Did you find the drive?"

"Yes."

"Where is it?"

David looked at Andrew.

Andrew said, "Answer."

"A bank safe-deposit box."

"Which bank?"

"First Provincial.

Downtown branch.

Box 418."

"Whose name?"

"Mine."

Alvarez sat back.

"Why didn't you destroy it?"

David looked genuinely ashamed.

"Because I wanted leverage against my mother."

That answer surprised everyone.

"Explain."

"The files prove she authorized most of the transfers.

I thought if Rachel tried to expose me, I could use the same records to force Mom to protect me."

Andrew stared at his client with open disgust.

David saw it.

"I know how it sounds."

Alvarez's voice sharpened.

"Stop saying that.

We know how it sounds because we know what happened."

David flinched.

"Did your mother know you found the drive?"

"No."

"Did she know you stored it?"

"No."

"Did anyone else?"

"No."

A warrant was obtained within hours.

The safe-deposit box contained the encrypted drive, two photocopied ledgers, and a handwritten note from Rachel.

The note had been folded around the drive before David removed it from the music box.

He had kept that too.

It read:

If anyone finds this, give it to Claire or the police.

If something happens to me, do not let them say I was unstable.

I am scared of what they will do to keep the twins.

Alvarez stood in the bank vault holding the note in gloved hands.

For a moment, nobody spoke.

Then the federal financial crimes unit was called.

The case split into two investigations.

One involved the money.

The other involved the children.

They were no longer separable.

At the hospital, Rachel learned David had confessed to returning to the house.

She did not cry.

She looked at Claire and said, "I knew I wasn't imagining it."

Claire felt a cold anger rise.

"Did he make you think you were?"

Rachel nodded.

"For months.

Every time I remembered something differently, he said I was stressed.

Hormonal.

Confused."

"And Evelyn?"

"Worse."

Rachel looked toward the NICU corridor.

"They kept telling me I was unstable until I started checking whether I was."

Claire squeezed her hand.

"You're not."

Rachel closed her eyes.

"I left my six-year-old alone for three days."

"You were unconscious."

"She still lived it."

Claire did not argue.

Some pain should not be contradicted into silence.

It had to be carried until it became smaller.

That night, Emma asked to see her mother.

ICU approved a short visit.

Claire brought her in.

Rachel lifted both arms weakly.

Emma ran to the bed but stopped before climbing onto it.

"Does it hurt?"

"A little."

"Can I hug you?"

"Please."

Emma leaned carefully against her.

Rachel pressed her face into her daughter's hair.

"I'm sorry."

Emma pulled back.

"For sleeping?"

Rachel's face crumpled.

"For everything."

Emma thought about that.

Then she said, "You didn't know you were sleeping."

Rachel laughed and cried at the same time.

"No. I didn't."

Emma touched her cheek.

"I got the babies help."

"You did."

"Are you proud?"

Rachel's eyes filled.

"More than I can ever explain."

Emma smiled.

Then she became serious.

"Can I stop being brave now?"

Rachel closed her eyes as tears spilled free.

"Yes, baby."

She pulled Emma closer.

"You can stop now."

Outside the room, Marisol turned away to wipe her face.

Detective Alvarez's phone rang.

The prosecutor was calling.

David Mercer was being arrested.
